I am currently a third-year law student and have recently started taking an interest in legal research and academic writing. While I have written a few blog posts and case comments, I now want to write a full-length research article for submission to reputed student-run law journals published by leading National Law Universities. However, I find that the most difficult part of the entire process is choosing the right research topic.
The problem is that almost every topic I think of already has several published articles, and I struggle to identify a genuine research gap or a novel legal issue worth writing about. I often spend weeks reading existing literature, only to realize that my proposed topic has already been explored extensively. At the same time, I am hesitant to choose an emerging issue because I am unsure whether there is enough primary material or jurisprudence to support meaningful research.
My question is: When deciding on a research topic for publication in a reputed law journal, how do you identify whether an idea is sufficiently original, relevant, and academically valuable? Are there any practical methods or research techniques that you recommend for finding unexplored legal issues or genuine research gaps that are likely to interest journal editors?
