Bharatiya Nagarik Suraksha Sanhita, 2023

The Bharatiya Nagarik Suraksha Sanhita, 2023 consolidates and amends the law relating to criminal procedure in India. It contains provisions dealing with the functioning of criminal courts, powers of courts and Magistrates, investigation, arrest, bail, trials, appeals, and other stages of criminal proceedings.

The BNSS is a procedural law. It should therefore be read alongside the substantive criminal law contained in the Bharatiya Nyaya Sanhita, 2023 (BNS) and the rules of evidence contained in the Bharatiya Sakshya Adhiniyam, 2023 (BSA).

BNSS Chapters and Sections

The BNSS is organised into chapters containing provisions dealing with different stages and aspects of criminal procedure. Its sections cover matters such as criminal courts, powers of courts, arrest, investigation, jurisdiction, bail, trials, judgments, appeals, execution of sentences, and other criminal proceedings.

Students studying criminal procedure should read the statutory language carefully, particularly the conditions, exceptions and procedural requirements contained in individual sections.
